Terms and Conditions and Returns Policy
REGULATIONS OF THE YOU-NICK.PL ONLINE STORE
(effective from November 12, 2025)
§1. General provisions

Online store available at https://you-nick.pl (hereinafter referred to as the "Store") is run by You-Nick spółka z ograniczoną odpowiedzialnością with its registered office in Wrocław, ul. Ślężna 148, 53-111 Wrocław, entered into the Register of Entrepreneurs of the National Court Register under the number 0000417827 , NIP 8992735469 , REGON 021861326 , (hereinafter referred to as the "Seller").

The Regulations are made available free of charge on the Store's website in a manner enabling their acquisition, recording and reproduction.

The Customer of the Store may be a consumer, entrepreneur or other entity.
Contracts are concluded in Polish or – in the case of foreign sales – also in another language available on the Store's website. -
The store allows you to place orders from selected European Union countries.
In the case of purchases made outside Poland, commercial information (including prices, payment methods, delivery costs) may be presented in the local currency of the Customer's country. -
The presentation currency is selected automatically based on the location or manually selected by the Client (if such functionality is available).

The sales contract is subject to Polish law, however, the mandatory provisions of the consumer's country of residence (EU) take precedence if they provide a higher level of protection.
§2. Information required before concluding a contract
Before placing an order, the Customer receives in particular:

main features of the service – in the product description;

data identifying the Seller – in accordance with §1;

total price including taxes and delivery costs – presented in the basket and at checkout in the currency appropriate to the country of purchase ;

method and date of payment and method of delivery;
-
information on the right to withdraw from the contract – §7;
-
information on liability for the conformity of the goods with the contract (warranty) – §6;
-
duration of the contract – contracts are one-off;
-
information on complaint and ADR procedures – §10.
§3. Conclusion of the contract

The order is placed by adding the Product to the cart, completing the required data and clicking "Buy and pay".

After placing an order, the Customer receives automatic confirmation of its acceptance.

The contract is concluded when an e-mail entitled "Order Confirmation" is sent to the Customer.

In the event of an obvious error in the price or description, the Seller may cancel the order (this does not limit the consumer's rights under the law).
§4. Prices, Promotions and Payments

Product prices may be presented in different currencies (including PLN, EUR, USD or other currencies available in the countries of sale).
The presentation currency depends on the customer's location or their manual selection. -
The transaction settlement currency is clearly indicated in the order summary before placing the order ("I buy and pay").

Prices include VAT in accordance with applicable regulations:

for deliveries to Poland – Polish VAT,
-
for deliveries to other EU countries – VAT of the recipient country in accordance with the OSS procedure.

Prices do not include delivery costs, which are presented separately during the ordering process.

Available payment methods include:
fast online transfer, payment cards (Visa/Mastercard/AmEx), Apple Pay, Google Pay, BLIK (for orders from Poland), Klarna and other methods available locally. -
Price Reductions (Omnibus Directive): Each price reduction displays the lowest price from the 30 days prior to the reduction (or since the product went on sale). This information is visible next to the promotional price, regardless of the currency in which the price is displayed.
§5. Delivery

Delivery is made within the territory of Poland and selected European Union countries indicated in the basket or checkout.
The list of available countries may be updated. -
Current shipping costs and options are presented in checkout before placing your order.

The seller delivers goods without defects.
§6. Complaints (warranty) and compliance of goods with the contract

The seller is liable to the consumer for the conformity of the goods with the contract.

The complaint should include:
Customer details, order number, description of the non-conformity and request. -
The seller responds within 14 days.
Failure to respond means that the complaint is accepted within the scope of the consumer's request. -
The warranty liability towards the consumer lasts for 2 years.

Liability under warranty towards entrepreneurs (Article 43¹ of the Civil Code) is excluded.
§7. Withdrawal from the contract (returns)

The consumer may withdraw from the contract within 14 days of receiving the goods, without giving any reason.

The declaration can be sent by e-mail, by post or via the online form:

The customer returns the goods no later than 14 days after submitting the declaration.

The costs of returning the goods are borne by the customer.
-
The Seller will refund the payments (including the cost of the cheapest standard delivery) within 14 days, but may withhold this until the goods have been returned or proof of having been sent back has been provided.

The customer is responsible for any reduction in value resulting from use of the product beyond what is necessary.

Exclusions:
The right of withdrawal does not apply to products made to the Customer's individual order, including:-
custom-cut spectacle lenses,
-
frames with individual lenses installed,
-
personalized products (color, shape, individual parameters).

EU consumers:
the right of withdrawal is applied in accordance with Directive 2011/83/EU and the law of the consumer's country of residence.
§8. Warranty

The seller provides a 12-month quality warranty on the products.

Detailed conditions may be specified in the warranty document or on the Store's website.

The guarantee does not exclude warranty rights.
§9. Customer Account and Newsletter

Creating an account is not mandatory.
-
The customer may request deletion of the account at any time.
-
The newsletter is sent only with the Customer's consent; each message contains a link to unsubscribe.
§10. Final Provisions, ADR

In matters not regulated, Polish law shall apply.

The jurisdiction of the court is determined in accordance with general provisions.
-
The seller provides transparent after-sales procedures (returns, complaints).
-
The consumer may use out-of-court dispute resolution methods, in particular through the provincial inspectorates of the Trade Inspection or other ADR entities indicated on the UOKiK website.

Consumers making purchases from other EU countries can also use the European Commission's ODR platform:

The Regulations enter into force on 12 November 2025.

Storage period: until the expiry of the complaint deadlines and those required by accounting regulations.

Customer rights: access, rectification, deletion, restriction, transfer, objection.
